Marine Vet Found Not Guilty, Charges Dropped In Homicide Case
Marine veteran Daniel Penny was found not guilty of negligent homicide Monday in the death of Jordan Neely.
Penny, 26, was accused of multiple crimes, including negligent homicide and second-degree manslaughter, after he restrained Neely, 30, who was “yelling and acting erratically on the F train after boarding” [the New York City subway], according to the Daily Caller. “New York City and the state of New York have faced an uptick in crime in recent years. City residents have said that the general quality of life has decreased as violent crime has risen, with under half of New Yorkers saying they felt safe using the subway in 2023,” Daily Caller wrote in their analysis. “Liberal prosecutors, including Bragg, have been criticized for “soft-on-crime” policies, including a refusal to prosecute repeat-offenders. Jordan Neely was arrested 42 times prior to the subway altercation.”
Soft-On-Crime Policies Lead To Violence
A defense lawyer in the case said Monday that Neely was “violent and desperate” when he boarded the train, and “filled with rage and not afraid of any consequences,” the outlet continued. Neely showed signs of K2 (synthetic marijuana) in his system at the time of the incident. Two separate medical examiners claimed opposing causes of death, with one saying it was Penny’s extended chokehold. The other said “the combined effects” of schizophrenia, drug abuse, his resistance and restraint and a blood condition, could have led to Neely’s death. But neither witnesses nor footage revealed that Penny used a fatal chokehold.
