State AG Investigating Gym Over Male In Women’s Locker Room

Missouri Attorney General Andrew Bailey announced in August that he is investigating Life Time Fitness in Chanhassen, Missouri, over an alleged policy allowing biological men into the women’s locker room.

“It has come to my attention that Life Time Fitness has proudly adopted a policy that permits biological men to use locker rooms designated specifically for women and young girls. Even more concerning is the fact that instead of taking the safety concerns from your gym members seriously, you rudely correct them and insist they call this biological male by the ‘correct pronouns,'” Bailey wrote in the investigation notice to the gym owner.

“While it might be considered fashionable in certain corporate boardrooms to pretend that biology is irrelevant, the American heartland still lives in reality. Criminal Trespass, Sexual Offenses

Bailey cited a case which he personally prosecuted that found a male’s presence in a females’ public restroom is considered criminal trespass in the state. “Additionally, a male who exposes his genitals in the presence of others in the restroom may be subject to further criminal liability for multiple sexual offenses, including sexual misconduct in the first degree and the felony offense of sexual misconduct involving a child,” Bailey added, citing two state statutes. “Your policies are enabling potentially criminal behavior, and I am writing to assure you that it will not continue on my watch.”

Other Lawmakers Speak Out

Republican Missouri state Rep. Justin Sparks issued a statement Thursday calling for the investigation. “The use of this facility by the individual in question raises significant concerns about the safety and privacy of all members, particularly minors,” he noted.

The gym also issued a statement in which they seemed to argue the situation only occurred because “the State of Missouri provides a mechanism for an individual to change their gender designation on their state-issued drivers’ license.” (LEARN MORE: Catholic Bishops Issue Statement About Trans Medicine)

“In this instance, the member presented a state-issued drivers’ license identifying as female and, based on Missouri laws, we cannot deny or discriminate on the basis of sex,” they stated.
