Texas Attorney General Ken Paxton filed a lawsuit in Dec. against a New York physician for allegedly illegally mailing abortion drugs to a resident of Texas.
The suit filed against Dr. Margaret Daley Carpenter accuses her of providing a Collin County resident with abortion-inducing drugs that killed an unborn child and “resulted in serious complications for the mother, who then required medical intervention,” according to a statement from Paxton. Texas laws does not allow medical suppliers and doctors to send abortion-inducing drugs to the state via courier, delivery, or any type of mail service. Doctors cannot prescribe Texas residents with telehealth services unless they hold a valid license to do so in the state. (RELATED: US Ally Makes Silent Prayer Illegal Outside Abortion Clinics)
“In this case, an out-of-state doctor violated the law and caused serious harm to this patient. This doctor prescribed abortion-inducing drugs—unauthorized, over telemedicine—causing her patient to end up in the hospital with serious complications. In Texas, we treasure the health and lives of mothers and babies, and this is why out-of-state doctors may not illegally and dangerously prescribe abortion-inducing drugs to Texas residents,” Paxton said in the statement.
What Is Paxton Asking For?
Paxton is requesting the court “enjoin Dr. Carpenter from violating Texas law and impose civil penalties of no less than $100,000 for each violation of the law.” (LEARN MORE: Education Sec. Linda McMahon To Return Power To States)
Texas has a firm ban on all abortion procedures except in circumstances where the mother’s life is in imminent danger in the context of a medical emergency, the Christian Post reported. The 20-year-old Collin County resident involved in this case was prescribed 200mg of mifepristone and 4 200 mcg of misoprostol. “On July 16, 2024, the mother asked the biological father of her unborn child to be taken to the hospital because of hemorrhage or severe bleeding. After the mother was
seen by health care professionals at a hospital in Collin County, Texas, the biological father of the unborn child was told that the mother of the unborn child was experiencing a hemorrhage or severe bleeding as she “had been” nine weeks pregnant before losing the child,” the lawsuit states.
