Illinois judge Tracie Porter barred former President Donald Trump from appearing on the state’s Republican primary ballot and November election ballot, Wednesday.
The Cook County judge delayed her ruling from taking effect as it’s believed Trump and his team will appeal the ruling ahead of the primary vote on March 19, Newsmax reported. Porter cited the U.S. Constitution’s 14th Amendment clause as the reason for her ruling. (LEARN MORE: Biden Sued Over Conservative Censorship)
A similar argument is taking place in Colorado, but the ruling may not be upheld by higher courts. One of the dissenting justices in Colorado’s Supreme Court noted that Trump has been refused the right to due process and no jury has found him guilty of causing or organizing an insurrection. “Even if we are convinced that a candidate committed horrible acts in the past – dare I say, engaged in insurrection – there must be procedural due process before we can declare that individual disqualified from holding public office,” Judge Carlos Samour wrote of the Colorado ruling.

“The court also realizes the magnitude of this decision and its impact on the upcoming primary Illinois elections,” Porter said in her Illinois ruling, according to Axios. (LEARN MORE: Supreme Court To Hear Ultimate Free Speech, Censorship Case)
“Today, an activist Democrat judge in Illinois summarily overruled the state’s board of elections and contradicted earlier decisions from dozens of other state and federal jurisdictions,” Trump’s campaign spokesperson Steven Cheung said in an email. The U.S. Supreme Court is weighing the ruling in Colorado. If it passes, then the decision will essentially render voters in these states without the right to choose a future president.
