Florida Draws the Line on Communist Land Buys

Across the United States, a growing concern has captured the attention of lawmakers and citizens alike: individuals linked to adversarial governments are purchasing American land. Many argue that this trend poses a national security risk and undermines the values that make America free. Florida recently took a bold stand on this issue, passing a law to restrict certain foreign nationals, especially those connected to the Chinese Communist Party, from buying property in the state. The reasoning is clear: those who oppose freedom should not be allowed to buy pieces of it.
In May 2023, Governor Ron DeSantis signed Senate Bill 264 into law. The legislation prohibits certain foreign nationals, particularly those domiciled in China without U.S. citizenship or residency, from purchasing real estate in Florida. The concern is not merely economic. Critics of the Chinese regime warn that the Chinese Communist Party (CCP) has used front companies and intermediaries to acquire land near critical infrastructure or military installations. Such purchases could give Beijing leverage over American agriculture, industry, or even national defense.
Just this week, the U.S. Court of Appeals for the Eleventh Circuit upheld the law, rejecting a challenge brought by several Chinese nationals. The court ruled 2–1 that the plaintiffs lacked standing because they did not qualify under the law’s criteria. The decision affirms that Florida, and by extension, other states, has the right to protect its land from adversarial control. Florida Attorney General James Uthmeier praised the ruling, saying the decision “preserves our ability to protect Florida’s citizens, farmland, and military installations from Communist influence.”

Land ownership is not just about property rights; it represents sovereignty, security, and the values that define a people. When individuals aligned with foreign regimes, especially authoritarian ones, gain ownership of land, the threat extends beyond economics. It becomes a question of whether the United States can maintain control of its own soil.
Land purchases by foreign nationals tied to adversarial governments have raised alarms for years. Reports have shown Chinese investors acquiring farmland near U.S. Air Force bases, and similar patterns have emerged in other states. These actions are not random. They are part of a global effort by the CCP to extend influence and power beyond its borders. America’s open markets make such acquisitions easy, but Florida’s law is a reminder that openness must be balanced with vigilance.
The Florida law specifically targets “countries of concern,” which include China, Russia, Iran, North Korea, Cuba, Venezuela, and Syria. U.S. citizens and lawful permanent residents from those nations are exempt, but those living abroad are not. The goal, according to state officials, is not discrimination, it’s defense. It ensures that those who hold loyalty to foreign powers cannot buy property that may later be used to threaten the public interest.
The Moral Line Between Investment and Infiltration
Critics have argued that Florida’s law could lead to discrimination or interfere with federal authority. Civil liberties groups claimed the legislation oversteps state power and infringes upon equal protection. But the Eleventh Circuit Court disagreed, saying that state sovereignty allows Florida to protect its territory from external threats. States have always held the right to regulate land ownership, especially when tied to public safety or national defense.
The moral issue is simple: should those who despise liberty, censor speech, and control their citizens through tyranny be allowed to buy pieces of America? Many would argue no. America is not obligated to sell its heritage to those who would dismantle it. Allowing communist-aligned investors to purchase strategic property here is like inviting a fox into the henhouse and calling it free trade.
The Chinese Communist Party is not just another foreign government, it is an adversary. Its values reject the very freedoms that define American life: freedom of religion, freedom of speech, and private property rights. Florida’s action recognizes that not all buyers have good intentions. It draws a clear moral and civic line between honest investment and ideological infiltration.
Defending the Homeland Through State Action
Florida’s stance could become a model for other states. Over 30 states have already considered similar restrictions on foreign ownership of farmland or strategic property. Each is driven by the same realization: national security does not stop at the federal level. It begins in our counties, towns, and states.
Federal agencies like the Committee on Foreign Investment in the United States (CFIUS) oversee corporate mergers and national transactions, but they cannot monitor every land deal in 50 states. That’s why state action matters. Florida’s decision to defend its territory should encourage others to do the same.
For everyday Americans, this is about ensuring that their communities, farmland, and water resources remain in American hands. Land is more than an asset, it’s a legacy. Selling it to entities aligned with regimes that oppose freedom undermines that legacy and weakens the very foundations of self-government.
If America is to remain strong, it must guard both its borders and its backyards. That means saying “no” to foreign adversaries who would buy a stake in our soil, and “yes” to protecting liberty at home.
The Eleventh Circuit’s decision to uphold Florida’s law marks a significant victory for sovereignty and security. It reminds the nation that freedom is not just defended abroad, it is protected at home, one parcel at a time. States have the moral and legal authority to prevent hostile powers from buying influence through real estate.
America should remain open to honest investment and opportunity, but we must not confuse openness with recklessness. Those who reject liberty should not be allowed to purchase the land of the free.
