Christians, Free Speech Win Big In Colorado

The Colorado Supreme Court dismissed a lawsuit Tues. (Oct. 8) against Christian baker Jack Philips over his refusal to make a pro-transgender cake.

The court ruled 3-4 to dismiss the suit against Philips, who simply refused to spend his time making a cake related to an individual’s decision to mutilate their reproductive organs under the guise of so-called “gender affirming care,” The Christian Post reported. Philips is the owner of Masterpiece Cakeshop, and was sued by Autumn Scardina, a biological man who identifies as a woman.

Justice Melissa Hart wrote the court’s majority opinion in favor of the dismissal, noting that the claim was not properly processed prior to the lawsuit being filed. “Could the district court properly consider the claims of discrimination presented here? Second Case Philips Has Won

This is the second time Philips has won a lawsuit brought against him for his refusal to do business with people he doesn’t want to. In 2018, the Supreme Court sided with Philips in his decision to not make a same-sex wedding cake, according to another article from the Christian Post.

At the time, the court ruled 7-2 that Colorado violated Free Exercise Clause of the First Amendment by penalizing Philips and his cake shop. “The laws and the Constitution can, and in some instances must, protect gay persons and gay couples in the exercise of their civil rights, but religious and philosophical objections to gay marriage are protected views and in some instances protected forms of expression,” a summary of the majority ruling notes.  (LEARN MORE: Pro-Life Leaders Share Thoughts On Kamala Harris Presidency)

“While it is unexceptional that Colorado law can protect gay persons in acquiring products and services on the same terms and conditions as are offered to other members of the public, the law must be applied in a manner that is neutral toward religion.”
