When children lose their parents, they face unimaginable heartbreak and uncertainty. In many cases, these vulnerable children enter the foster care system looking for safety and support. Unfortunately, many states have been quietly taking the financial resources left behind by their deceased parents.

This unfair practice is widely known as the orphan tax. It leaves already struggling children without the money their parents worked hard to provide. Helping those in need is a foundational guiding truth for our communities and our nation.

Thankfully, the Trump Administration is stepping up to stop this unjust practice.

There are currently more than 300,000 children in the U.S. child welfare system. Out of those, roughly 27,000 children receive survivor benefits or supplemental income. This means thousands of kids are actively losing money they desperately need for their future.

Understanding the Unfair Orphan Tax

Social Security benefits are meant to help children cover essential needs like housing and education. When a parent passes away, these funds belong entirely to the surviving child. However, when children enter state care, the local government often intercepts this money.

State child welfare agencies take these funds to reimburse their own costs for housing the children. Every child in the foster care system costs the state the exact same amount of money. Yet, only orphans with survivor benefits are forced to pay for their own care.

This policy creates a massive disadvantage for youth who are already facing steep challenges. The Social Security benefits could be used for a down payment on a house or college tuition. Instead, the money disappears into massive government budgets.

When youth age out of the foster care system, many face homelessness or unemployment. They enter adulthood without the vital safety net their families intended to leave them. Having the resources their parents left behind could change their entire trajectory in life.

This is why many advocates consider the orphan tax to be deeply and morally wrong. These children are not in foster care by any fault of their own. They certainly should not be asked to foot the bill for their own survival.

Protecting the most vulnerable among us is a core biblical principle. We are called to look after orphans in their distress and ensure they receive fair treatment. Taking away their rightful inheritance goes against the very idea of justice and equal opportunity.

The Trump Administration Takes Action

Recognizing this injustice, the Trump Administration has launched a nationwide effort to protect these children. The Department of Health and Human Services is leading the charge to end the orphan tax completely. They are using every available lever to make sure orphans are treated fairly.

Recently, the Administration for Children and Families sent official letters to 39 governors. These letters strongly urged state leaders to stop diverting foster youth’s earned funds. The Trump Administration is demanding immediate action to protect these vital resources.

Officials have warned that taking these funds from orphans is morally shocking and corrupt. They believe that no state budget director should balance their budget on the backs of grieving children. Every governor has the power to end this practice through courage and executive action.

The good news is that these federal efforts are already starting to produce real results. Since the letters were sent, at least 10 states have changed their policies regarding these funds. States like Utah, Idaho, Mississippi, and Kentucky have successfully passed new legislation to protect orphans.

Other states have seen their governors sign executive orders to end the orphan tax immediately. This shows that when leaders are pushed to do the right thing, positive change happens. However, there is still a long way to go to protect children in every single state.

Federal officials are actively traveling the country to work with state welfare directors. They are providing resources and technical assistance to help states update their outdated policies. The goal is to ensure every child has the chance to reach their full, God-given potential.

As citizens, our active involvement is essential to upholding justice in our nation. We cannot sit idly by while vulnerable children are stripped of their rightful resources. It is time to mobilize pastors and people of faith to address this critical issue.

Talk to your local representatives and ask them where they stand on the orphan tax. Share this information with your congregation and encourage your church to get involved. Your state has the ability to address this issue within its state laws. Send your state representative an email or give them a call.
