Louisiana Still Has Ten Commandments In Schools Despite ACLU Lawsuit

Mainstream corporate news media and the American Civil Liberties Union is misrepresenting a recent ruling by the 5th Circuit Court of Appeals in New Orleans on the display of Ten Commandments in all classrooms.

The law was called “plainly unconstitutional” by a three-judge panel, who unanimously voted to try and shut down the law, according to Reuters. While the ruling technically blocks Louisiana from enforcing a law requiring the display of the Ten Commandments in public schools and universities, an estimated 95% of schools have already put up the displays and are not taking them down.

Reuters called the ruling a “victory for parents and students who accused Louisiana of trampling on their religious rights.” However, the Ten Commandments was part of U.S. educational curriculum up until roughly 50 years ago, which begs the question: are these students and teachers simply victims of propaganda and manipulation by those who seek to eradicate the truth of America’s history — and the history of Western civilization? The answer doesn’t really matter, as the case will now move up through the courts, with Louisiana Republican attorney general Liz Murrill saying she will take the case all the way to the Supreme Court if necessary.

Another major issue with the 5th Circuit’s ruling is that it was based on the famous Stone v. Graham case, wrote Axios, which was essentially overturned in 2022 — news that may not have reached the liberal majority court — in the Kennedy vs. Bremerton School District case. It is unfortunate that those on the court are unaware of the redundancy in the Stone vs. Graham case, but this does now allow the case to move through the rest of the courts until someone understands the latest legal precedent.

Understanding The Law

“For 200 years, before the Stone vs. Graham case (1980) in Kentucky took the Ten Commandments out of our schools, kids were exposed to these rules. Kids were educated on how the Ten Commandments was part of Western Civilization; no other document has had such an influence or impact,” Texas Sen. Phil King explained to Million Voices. “The Bible was a tremendous influence to our Founding Father’s lives, and the way they chose to structure the constitution,” he continues. “Up until around 1971, Judeo-Christian ethics and commentary existed throughout our public square, but when Lemon vs. Kurtzman was written by the Supreme Court, it established the ‘Lemon Test,’ that forced people to check a load of boxes before getting any type of Christianity into our public square. We had a long cultural history of these things, and people have been able to use the ‘Lemon test’ to remove Christ from our public square.”

Circuit Judge Irma Carrillo Ramirez, after citing Stone vs. Graham, “rejected Louisiana’s argument that the Supreme Court’s 2022 decision favoring a Washington state high school football coach who prayed with players at the 50-yard line after games required upholding the Ten Commandments law,” (Kennedy vs. Bremerton), according to Reuters.

SCOTUS Will Rule In Favor

The Supreme Court currently sits with a 6-3 conservative majority, Reuters described — though the court is famously meant to be apolitical. In the last several years, SCOTUS has ruled repeatedly in favor of religious freedoms.

“In 2022, the Supreme Court struck down the Lemon test in the Kennedy vs. Bremerton case, but we’ve still got all this bad case law throughout the country built upon this bad ruling. I call it the Ghost of Lemon,” King continued in our conversation.

“So one of the things I hope will happen with the Ten Commandment legislation — we know it’ll be used for lawsuits — is that we can work those cases up through the courts, and eventually the Supreme Court will overturn cases like Stone vs. Graham, and this will keep happening throughout all of the laws and cases built upon the ghost of Lemon. There are all these cases, many of which didn’t make it to the Supreme Court, that are built on this now-overturned case law. While the news headlines want you to believe that the Ten Commandments bill will not be enforced ever, this is simply untrue.
