State Pass Bill Restricting DEI In Higher Education

The Kansas House passed a bill Thursday that aims to restrict diversity, equity, and inclusion (DEI) oriented hiring practices at institutes of higher education, Politico reported.
The bill passed in an 81-39 vote. It prevents state universities, colleges, and technical schools from using DEI politics within admissions, student aid, and hiring decisions. It also prohibits schools from making any of these decisions based on the “political ideology of movement” the individual candidate may provide. Schools would be banned from even asking about this information.
“Instead of a merit-based approach, universities have chosen to embrace ideologies that discriminate against people who do not hew to their orthodoxy,” Republican Kansas state Rep. Steven Howe said prior to the vote. “This legislation prohibits all loyalty oaths, litmus tests without regard to viewpoint or ideology.”

Kansas would also reserve the right to fine schools found in violation of the policy up to $10,000. “Any person who believes their rights were violated through a violation of this section may file a complaint with the state board of regents. The board shall investigate the complaint to determine whether a
violation of this section has occurred. Such investigation shall be complete within 45 days after the date of the receipt of the complaint. If the board determines, after investigation, that a postsecondary educational institution has violated this section, the institution shall remedy the violation within 90 days after the date of such determination. If the institution fails to remedy the violation within 90 days, the board shall report the matter to the attorney general, who may file an action in district court against the institution for declaratory relief or enjoin the violation,” the bill noted.
