Supreme Court Justice Ketanji Brown Jackson came out as a surprise ally to former President Donald Trump during Thursday’s 14th Amendment arguments.
The U.S. Supreme Court heard arguments Thursday over whether Trump should be blocked from the Colorado primary ballot for 2024 over the 14th Amendment’s Insurrection Clause, according to The Hill. The most junior and liberal justices on the bench, Jackson, appeared to be sympathetic to Trump’s position.
“Can you speak to the argument that really Section 3 was about preventing the South from rising again in the context of these sort of local elections, as opposed to focusing on the presidency,” Jackson asked of the court. She focused on how the clause “specifically disqualifies insurrectionists from being senators, House lawmakers and presidential or vice-presidential electors but not explicitly presidents or vice presidents,” The Hill noted.
Voters Focus On One Clause
There’s a “catchall category” within the amendment, Colorado voters suing to keep Trump off the ballot argued, which reads “any office, civil or military, under the United States.” They argue this includes the presidential office. (LEARN MORE: Biden Sued Over Conservative Censorship)
“Why didn’t they put the word president in the very enumerated list in Section 3,” asked Jackson of the plaintiff’s attorney. “The thing that really is troubling to me … they were listing people that were barred, and ‘president’ is not there.”
