Supreme Court Makes Huge Decision On Bump Stocks

The U.S. Supreme Court ruled 6-3 in June that the government exceeded its authority when banning bump stocks.

The ruling came Friday, stating that the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) overstepped its authority when it tried to ban bump stocks under federal law in 2018, according to Forbes. Bump stocks were described as a “rapid-fire gun” accessory by The Associated Press, noting that one of these attachments was used during one of the deadliest mass shootings in recent U.S. history.

Justice Clarence Thomas further found the Justice Department was wrong to “declare that bump stocks transformed semiautomatic rifles into illegal machine guns because each trigger depression in rapid succession still only releases one shot,” the AP noted, citing the majority opinion. Justices Samuel Alito and Sonia Sotomayor both highlighted how “action in Congress” could lead to a lasting policy regarding bump stocks. President Joe Biden called on Congress to reinstate some type of ban.

How Did This Happen?

“Michael Cargill, who was a gun shop owner in Austin, Texas, filed a lawsuit challenging the Bureau of ATF’s rule, a ban on bump stocks. He won before the U.S. Court of Appeals for the Fifth Circuit. But the ruling wasn’t about the Second Amendment. “There can be little doubt that the Congress that enacted this law would not have seen any material difference between a machine gun and a semiautomatic rifle equipped with a bump stock. But the statutory text is clear and we must follow it,” Alito wrote.

Republican Ohio Rep.
