Judge Halts State From Legal Action Over Illegal Immigrants

U.S. District Court Judge Stephen Locher blocked Iowa’s ability to enforce its immigration laws, on Monday.

The law allows the state to file criminal charges against illegal immigrants who already have outstanding deportation orders, and who’ve previously been denied entry to the U.S., according to Fox. The block by Locher is likely temporary until the legislation is further litigated. But he believes it will fail because of federal immigration laws. “As a matter of politics, the new legislation might be defensible. As a matter of constitutional law, it is not,” Locher stated in his ruling. “Under binding Supreme Court precedent, Senate File 2340 is preempted in its entirety by federal law and thus is invalid under the Supremacy Clause.”

Leaders Reject Ruling

Republican Iowa Gov. Kim Reynolds signed the “illegal re-entry” bill into law in 2024, following a similar piece of legislation in Texas, Fox noted. (LEARN MORE: Biden’s Border Move Criticized By Voters)

“Iowa never would have had to pass this law to begin with if it weren’t for Biden’s open borders,” Iowa Attorney General Brenna Bird said in a statement after the ruling. “Rather than suing Iowa for enforcing immigration laws, he should do his duty to secure the border.”

A similar piece of legislation is expected to move through the legal system of Oklahoma. The Justice Department has already announced plans to “go after” the legislation, which was not further described by Fox News. (LEARN MORE: Terrorist Planning NYC Attack Stopped At Border)
